What are legal notices?

Legal notices published in Nevada newspapers can be by order of the court, but they can also be required by state law without a specific, case-by-case court order.

 1. By Order of the Court or Required by Law

Nevada law defines a "legal notice or advertisement" as any written matter required to be published in a newspaper:

• By any law of this State (a specific statute mandates the publication).

• By the order of any court of record in this State (a judge issues a direct order for publication in a specific case).

So, while not all notices are direct court orders, they are all mandated by the legal framework, often to ensure due process and public transparency.


 2. Kinds of Court Cases and Legal Matters Requiring Notice

Legal notices are typically required when a person or entity needs to give public notice of a legal action or a change in status, especially when the identity or location of all interested parties isn't known.

Here are some of the common types of court cases and legal matters in Nevada that require newspaper publication:

Service by Publication (Court-Ordered): This is often a direct court order. It's used to legally notify a defendant in a civil lawsuit (like divorce or other civil actions) when the defendant's address is unknown and they cannot be personally served. The notice serves as the required legalsummons.

Probate and Estate Administration:

Notice to Creditors: Required to inform potential creditors of a deceased person's estate so they can file claims.

Notice of Hearing on Petition to Probate a Will (to administer an estate).

Foreclosures and Property Sales:

Notice of Sale of property to satisfy an unpaid debt or a court judgment (e.g., a sheriff's sale).

Notice of Default and Trustee's Sale of real property in a foreclosure action.

In all cases, the notice must be placed in a "qualified newspaper of general circulation" in the appropriate county, as defined by Nevada Revised Statutes (NRS).

Service on Missing Parties: When a defendant in a civil suit (like a divorce or quiet title action) cannot be found, the court orders Service by Publication. Step 3: Publishing the Notice
